1.Acceptance of terms
These Terms of Service (the “Terms”) form a legally binding agreement between you (“you”, “user”, or “client”) and Sage Mitra Private Limited (“Sagemitra”, “we”, “us”).
By accessing or using the Sagemitra website, mobile app, or any service offered through it, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the platform.
2.Services we provide
Sagemitra is a digital mental wellness platform offering:
- Individual therapy sessions with verified mental health professionals
- Group therapy and moderated support groups
- Self-assessment psychometric tests for educational purposes
- Wellness courses and educational content
- Workplace and corporate wellness programmes
The exact services available to you may depend on your subscription, your employer’s programme, your geography, and therapist availability.

4.Eligibility
- You must be at least 18 years old to create an account.
- Individuals under 18 may use the service only through an account created and operated by a parent or legal guardian, who provides informed consent on the minor’s behalf.
- You confirm that the information you provide is accurate and that you have the legal capacity to enter into this agreement.
5.Account & security
- You are responsible for maintaining the confidentiality of your login credentials.
- You must not share your account with anyone else.
- You must notify us at support@sagemitra.com immediately if you suspect unauthorised access to your account.
- We may suspend or close accounts that show signs of misuse, fraud, or policy violation.
6.User conduct
You agree not to:
- Impersonate another person or provide false information
- Record, transcribe, or republish therapy sessions without explicit written consent
- Harass, threaten, or abuse therapists, staff, or other users
- Upload or transmit content that is unlawful, defamatory, infringing, or harmful to minors
- Attempt to access non-public areas of the platform or other users’ data
- Use the platform for any unlawful purpose or in violation of these Terms
We may suspend or terminate access for any conduct we reasonably believe violates these rules.
7.Informed consent for therapy
Before your first therapy session you will be asked to review and accept an Informed Consent statement that explains:
- The nature and purpose of therapy
- Confidentiality and its legal limits (see Privacy Policy section 5)
- Your right to withdraw from therapy at any time
- Risks, benefits, and alternative options
- Fees and cancellation policy
Therapy can begin only after you have given this consent. You may withdraw consent at any time, although fees already incurred may not be refundable.
8.Therapist relationship
- Therapists on Sagemitra are independent practitioners, not employees of Sagemitra.
- The clinical relationship is between you and the therapist; Sagemitra provides the technology, payment, and support infrastructure.
- We verify therapists for valid registration (e.g. RCI) where applicable, but we do not guarantee specific clinical outcomes.
- Any therapeutic approach, opinion, or recommendation is the professional judgement of the treating therapist.
9.Payments, cancellations & refunds
- Session fees are displayed before booking and charged at the time of booking.
- Payments are processed by third-party payment gateways; we do not store full card details.
- Cancellation and rescheduling rules, including any cancellation fees, are shown at the time of booking and in our separate Refund & Cancellation Policy.
- Therapist no-show: a full refund or free reschedule will be provided.
- Disputes regarding charges must be raised within 7 days of the transaction by writing to support@sagemitra.com.
10.Intellectual property
- All content on the platform — including the brand “Sagemitra”, logo, courses, articles, tests, designs, and software — is owned by Sage Mitra Private Limited or its licensors and is protected by Indian and international copyright laws.
- You receive a personal, non-exclusive, non-transferable licence to access and use the platform for your own personal, non-commercial use.
- You may not copy, redistribute, modify, reverse-engineer, or commercially exploit any part of the platform without our prior written consent.
11.Third-party services
The platform integrates third-party services such as payment gateways, video infrastructure, and analytics tools. Their use is governed by their own terms and privacy policies. We are not responsible for the acts, omissions, or content of third-party services.
12.Disclaimers
- The platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.
- Information available through the platform — including blogs, self-assessment tests, and educational content — is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
- We do not guarantee that the platform will be uninterrupted, error-free, or available at all times.
13.Limitation of liability
To the maximum extent permitted by law:
- Sagemitra shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.
- Our total aggregate liability for any claim arising from or relating to these Terms or the platform shall not exceed the total fees you paid to Sagemitra in the three (3) months preceding the event giving rise to the claim, or INR 10,000, whichever is higher.
- Nothing in these Terms limits liability that cannot be limited under applicable law.
14.Indemnity
You agree to indemnify and hold harmless Sagemitra, its officers, employees, contractors, and partners from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the platform, or your violation of any law or third-party right.
15.Termination
- You may close your account at any time by writing to support@sagemitra.com.
- We may suspend or terminate your account for breach of these Terms, unlawful activity, risk to other users or therapists, or where required by law.
- Sections concerning intellectual property, disclaimers, limitation of liability, indemnity, and governing law survive termination.
16.Governing law & disputes
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra, India.
Before initiating legal proceedings, both parties will attempt to resolve disputes in good faith by writing to support@sagemitra.com.
17.Changes to these terms
We may update these Terms from time to time. Material changes will be notified to registered users by email and reflected on this page with a revised effective date. Your continued use of the platform after the change takes effect constitutes acceptance of the updated Terms.
